Ethics Channel

In accordance with the provisions of the Law 2/2023, dated February 20, which regulates the protection of individuals who report regulatory violations and combats corruption, all companies that have more than 50 workers They are required to have an internal reporting channel that allows for the reporting of incidents that may constitute a serious criminal or administrative offense, or a violation of EU law.

Furthermore, the regulations stipulate the obligation to make information available to interested parties regarding the use of all internal reporting channels, as well as the essential principles of the procedure.

To ensure compliance with the above, we are providing you with the following:

This channel ensures compliance with the provisions of the aforementioned regulation, in accordance with Articles 7 and 9 thereof.

ANONYMOUS COMMUNICATIONS AND PERSONAL INFORMATION
Reports may be submitted anonymously; the reporter is not required to identify themselves. Responses will be sent through the same channel through which the report was received. To receive a response, you must keep the tracking code that will be assigned to you in the acknowledgment message.

Anonymity, shall be lifted only with the express consent of the informant or when it constitutes a necessary and proportionate obligation imposed by Union or national law in the context of an investigation conducted by national authorities or in the framework of judicial proceedings, in particular to safeguard the right of defense of the person concerned.

Compliance with current data protection laws will therefore be ensured throughout the process. (LOPD and GDPR)

When you go to file a complaint, you will notice that you are directed to an online tool outside the domain of SISTEMA AZUD, S.A. The message is forwarded to a third-party provider’s tool to ensure complete objectivity and transparency in the complaint handling process.

In any case, the external provider shall comply with the instructions set forth by SISTEMA AZUD, S.A. and always in accordance with current data protection laws, ensuring compliance with the obligations set forth in Article 28 of the GDPR.

Therefore, this tool may be used by any employee of SISTEMA AZUD, S.A. or any other third party who may have knowledge of unethical, fraudulent, or illegal conduct occurring within our organization.

This Ethics Channel is not the appropriate channel for issues related to your employment conditions or disciplinary matters. In such cases, you should follow the policies established by your organization.

The data controller is SISTEMA AZUD, S.A. which will process the information collected through this channel in compliance with a legal obligation set forth in Law 2/2023, of February 21, which regulates the protection of individuals who report regulatory violations and combats corruption, will process the information for the purpose of managing complaints received through this channel, ensuring the confidentiality of the complainant’s data, keeping them anonymous and not disclosing them to third parties unless their identification constitutes a necessary and proportionate obligation imposed by EU or national law in the context of an investigation conducted by national authorities or within the framework of legal proceedings, in which case it must be disclosed to the authorities competent in the matter.

Your data will be retained for a maximum period of 3 months from the time the data is entered into the system, but may remain blocked when necessary to demonstrate the operation of the crime prevention model or when required by the competent authority to initiate the corresponding investigation into the facts.
